Creditor Hearings in the Southern Part of Southwest Michigan

If you file for bankruptcy in Kalamazoo, Allegan, Berrien, Branch, Cass, Saint Joseph, or Van Buren County, your Section 341 Meeting (the Meeting of the Creditors) will be held in Kalamazoo at the Federal courthouse located at 410 West Michigan Avenue. Because it is right on Michigan Avenue, it is relatively easy to find. However, many people end up driving past the building because they cannot see the words "United States Court" on the building. Those words are covered up by branches and all that you can see is that it is the post office. So, if you find the post office, you are in the right place.

The biggest issue that people seem to have with this location is the parking (or lack thereof). So, make sure that you plan plenty of time to find parking and possibly walk a few blocks. There is no parking lot specifically for the courthouse. Most of the parking around the area is meter parking on the street, so it is a good idea to have some change with you when you go to your 341 meeting. There are meters right outside the building, but those meters have a one hour limit. This may be fine if your meeting is scheduled for 9:00, but beyond that, there is a very good chance that you will be there longer than an hour. There are other meters on side streets behind the courthouse that allow longer parking. There are also a couple parking garages within a few blocks, which provide reasonable rates for parking ($1.20 per hour at the time of writing).

Because the 341 meetings are in the Federal courthouse, you are not allowed to take your cell phone in with you. If you have it on you, you will have to take it back to your car. Don't be surprised, though, to see people with cell phones in the building. Lawyers are allowed to keep their phones with them.

You will also be required to pass through a metal detector as you enter the building and all purses, bags, etc. are passed through a scanner. So, make sure that you do not have any pocket knives, nail clippers, or anything else that can be considered dangerous. You must also show your driver's license (or other ID) as you enter the building. Keep your ID handy because you are also required to present your ID to the trustee at your 341 meeting.

The location for the 341 meetings consists of 4 rooms. You will walk directly into the waiting room and there are 3 other rooms off of that. Although the waiting room is decent sized, it can get quite crowded. This is because there are usually six to nine meetings for one trustee scheduled in one hour. There typically are not more than 2 trustees holding meetings on any given day. So, lawyers will often use one or two of the other rooms to meet with their clients.

Most often, there is a schedule of the meetings posted on the bulletin board in the waiting room. This will allow you to see where you are on the schedule and what meeting is currently being held. The trustee will call one case at a time, and you will enter the meeting room at that time. Unlike some other districts, Kalamazoo 341s are not open to observers. That means that you do not have to worry about anyone else listening to your meeting. On the other hand, you do not have the chance to listen to any other meetings before yours, which can be helpful for knowing what to expect at your meeting.
